Collaborative Law engages the disputing parties in a conciliatory and creative approach to resolving their dispute. The process brings the parties together with an explicit agreement to settle from the start. This written contract governs the process and stipulates that each party will engage in good faith bargaining, provide early and complete voluntary discovery, and protect the interests of the children. Each party retains the expertise of separate legal counsel, but counsel are bound and committed to reaching an agreement and thus barred from participating in court should there be a breakdown in the process. To further engage in creating an efficient process, all experts are retained jointly as neutrals and again barred from participating in any subsequent court proceedings.
